Terms of Service

1. Who you're contracting with
The AI Press Release (the "Service") is operated by Serial Marketer LLC ("we", "us", "our"). By accessing or using the Service you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
The Service provides tools to draft, grade, and publish AI-readable press releases, including a public grader, related utilities, and a release publishing wire.
3. Eligibility and account
You must be of legal age to enter into a contract. If you use the Service on behalf of an organization, you represent that you have authority to bind it. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it updated.
4. Acceptable use
You will not, and will not permit anyone to:
- use the Service unlawfully, fraudulently, or to send spam;
- infringe intellectual property or publicity rights of others;
- publish defamatory, deceptive, harassing, or unlawful content;
- interfere with or compromise the security of the Service (malware, probing, scraping, rate-limit evasion);
- reverse engineer, resell, or redistribute the Service;
- circumvent technical limits, credit gating, or moderation.
5. Your content
You retain ownership of press releases and other content you submit. You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display your content solely to operate and improve the Service, and to publish content you explicitly publish through the wire. You are responsible for ensuring you have the rights to submit and publish the content.
6. AI-generated outputs
The Service uses AI models to generate scores, rewrites, and other outputs. Outputs may be inaccurate or incomplete and are not legal, financial, or professional advice. You are responsible for reviewing and verifying outputs before relying on or publishing them. Do not use the Service to generate illegal content, deepfakes, hate speech, malware, or to attempt to jailbreak the underlying models. We may filter, refuse, or remove content and suspend accounts that violate these terms.
7. Intellectual property
We retain all rights, title, and interest in the Service, including software, documentation, branding, and underlying technology. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service.
8. Pricing and payment
Each account receives one free release credit. Additional release credits are available for purchase at $9 USD per credit. Pricing may change; changes will not apply retroactively to credits already purchased.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

10. Suspension and termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your license to use the Service ends; we may delete your account data after a reasonable period.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that outputs will be accurate.
12. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Nothing limits liability that cannot be excluded by law.
13. Indemnification
You will indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.
14. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in New York County, New York.
15. Changes
We may update these Terms. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.
